California law permits transsexuals to obtain new birth certificates.

California Custody and Visitation Law

Courts typically will not consider a parent’s sexual orientation in custody and visitation determinations unless it is shown to adversely affect or harm the children. There have been no cases dealing with transgender parents. The state Supreme Court has held that when a same-sex couple deliberately has a child through assisted reproduction both partners are the legal parents.

California Donor Insemination Law

California law explicitly allows artificial insemination of unmarried women and removes any paternity rights from the donor. However, the procedures must be performed with physician involvement to remove the donor’s legal rights or obligations with regard to a resulting child.
