Idaho Donor Insemination Law
Existing State Laws. Idaho law appears to allow unmarried women to use donor insemination and to remove parental rights from donors. Physician supervision is required.
The definition of artificial insemination under Idaho law does not involve marital status. However, the law provides that artificial insemination shall not be performed on a woman without her written consent and that of her husband.
The law explicitly states that the semen donor “shall have no right, obligation or interest” with respect to the child.
Selection of a donor and the procedure itself must be conducted by a licensed physician and/or people under his or her supervision. Violation of the physician supervision requirement is punishable as a misdemeanor.
