Federal Court to Rule on Oklahoma’s “Adoption Invalidation Law”

A federal court in Denver is considering the legality of a law passed by Oklahoma in 2004 that bans state officials from recognizing adoption by same-sex couples. Same-sex adoptive parents have challenged the law and a federal judge overturned it earlier this year. Oklahoma appealed that ruling and the 10th Circuit Court of Appeals in Denver will now consider the issue.
A gay man in Seattle challenging the law said he and his partner intended that their four-year-old adopted daughter would maintain a relationship with her birth mother from Oklahoma. Given Oklahoma’s law, the man says they will not enter the state until the law is changed.
