North Dakota Custody and Visitation Law

North Dakota courts typically will not consider a parent’s sexual orientation in custody and visitation determinations unless it is shown to adversely affect or harm the children. There are no published cases dealing with transgender parents or same-sex co-parents.

North Dakota Surrogacy Law

Under North Dakota law, traditional surrogacy agreements (in which the surrogate mother is the biological contributor of the egg) are void and unenforceable, but gestational surrogacy agreements (in which the surrogate mother is not the biological contributor of the egg) are legal and enforceable. The issue of surrogacy agreements involving lesbian, gay, bisexual or transgender (LGBT) individuals has not yet been considered by the courts.

Courts have used a parent’s gender identity or expression to deny, restrict or modify custody and visitation. Ohio courts have not granted custody or visitation rights to the non-biological parent of a child.
