State Laws
Kansas Custody and Visitation Law
There are no published cases dealing with lesbian, gay, bisexual or transgender parents. State law, however, does not seem to permit the consideration of factors that do not affect the best interests of the child to be used in custody and visitation determinations. There are no reported or published opinions dealing with same-sex co-parents.
Kansas Donor Insemination Law
There is no provision in Kansas law on donor insemination performed on an unmarried woman.
Kansas School Law
Kansas law does not address school issues relating to sexual orientation or gender identity.
Kansas Surrogacy Law
It is unclear how Kansas law would treat a surrogacy agreement that includes lesbian, gay, bisexual or transgender (LGBT) individuals because there are no statutes regarding surrogacy. However, two attorney general opinions indicate that surrogate parenting agreements in general are unenforceable in the state.
Kentucky Adoption Law
Kentucky Custody and Visitation Law
Kentucky courts have used a parent’s sexual orientation to deny, restrict or modify custody and visitation. The Kentucky Supreme Court, however, has recognized parental rights for a non-biological co-parent in a same-sex relationship. There are no reported or published opinions dealing with transgender parents or same-sex co-parents.
Kentucky Donor Insemination Law
Kentucky law permits unmarried women to undergo donor insemination.
Kentucky School Laws
Kentucky law does not explicitly address school issues relating to sexual orientation or gender identity.
Kentucky Surrogacy Law
There is no statutory provision in Kentucky directly addressing the validity of surrogacy agreements, but a Kentucky Supreme Court case and an Attorney General opinion indicate that uncompensated agreements may be permissible. The issue of surrogacy agreements involving lesbian, gay, bisexual or transgender (LGBT) individuals has not yet been considered by the courts.
