State Laws


Whether you’re lesbian, gay, bisexual, transgender or straight-supportive, your state’s laws probably have a major impact on your life. State laws govern everything from the legal status of relationships between same-sex partners to the ability of transgender people to list their correct gender identity on their birth certificates. The Human Rights Campaign works with state leaders to advance the rights of LGBT people across the nation, from Alabama to Wyoming.

New York School Laws

New York law does not address school issues relating to sexual orientation or gender identity.

New York Sodomy Law

The New York sodomy law was struck down in 1980.

New York Surrogacy Law

All surrogacy agreements, regardless of the sexual orientation of the individuals involved, are void and unenforceable under New York law.

North Carolina Adoption Law

North Carolina Birth Certificate Law: Gender Identity Issues

North Carolina will issue new birth certificates to post-operative transsexuals.

North Carolina Custody and Visitation Law

North Carolina courts have used a parent’s sexual orientation to deny, restrict or modify custody and visitation. There are no published cases dealing with transgender parents or same-sex co-parents.

North Carolina Donor Insemination Law

There is no provision in North Carolina law on donor insemination performed on an unmarried woman.

North Carolina Hate Crimes Law

State law does not address hate crimes based on gender identity or sexual orientation.

North Carolina Healthcare Laws

State healthcare laws relating to the LGBT community in the areas of medical decision making and hospital visitation.

North Carolina Marriage/Relationship Recognition Law

North Carolina law purports to ban recognition of marriages between same-sex couples. There are no other forms of relationship recognition for same-sex couples in state law or policies.
