Sexual orientation protected? No
No provision of Michigan law explicitly addresses sexual orientation discrimination. In the 1993 case Barbour v. Michigan Dept. of Soc. Servs., 497 N.W.2d 216 (Mich. Ct. App. 1993), the court held that "harassment or discrimination based upon a person's sexual orientation" is not protected under the Michigan Civil Rights Act. This ruling remains in effect. "Race, color, religion, national origin, sex or blindness" are the only classifications addressed under the Michigan penalty enhancement accommodation non-discrimination law. MCL § 750.147 (2002).
