Michigan Sodomy Law

Michigan prosecutes same-sex sexual conduct under the “indecency and immorality” statute where “gross indecency between male persons” in public or private was punishable with up to five years in prison/$2,500 fine. MCL § 750.338 (2002). Sodomy was also criminalized under the “Crime against Nature or Sodomy” law. MCL § 750.158 (2002). In the 1990 trial court case Michigan Org. for Hum. Rts. v. Kelley, No. 88-815820 CZ (Mich. Cir. Ct. Wayne Cnty. July 8, 1990), the court invalidated the gross indecency statute as unconstitutional. This ruling has yet to be challenged but may only extend to Wayne County.
