New York hate crimes law explicitly addresses violence motivated by the "belief or perception" of the victim's sexual orientation. NY CLS Penal §§ 485.00-05 (2002); § 240.30-31 (2002); and NY CLS CPL §200.50 (2002). See People v. Diaz, 727 N.Y.S.2d 298 (N.Y. Sup. Ct. 2001). As yet, New York has not addressed gender identity-based violence under this provision of the hate crimes law.
