Delaware Non-Discrimination Law

Gender identity protected? No
No provision of Delaware state law explicitly addresses the protection of gender identity. While Delaware law does not explicitly prohibit employment discrimination in the private sector based on gender identity, a 2009 executive order issued by Gov. Markell prohibits discrimination against executive branch state employees based on gender identity and expression.

Sexual orientation protected? Yes
Delaware law prohibits discrimination in employment, housing, public accommodations and other areas based on sexual orientation.
