Prior to 2011, Hawaii law did not explicitly prohibit employment discrimination based on gender identity, however, the Hawaii Civil Rights Commission, the agency responsible for enforcing the state’s non-discrimination laws, had determined that gender identity and expression were protected under the laws prohibiting discrimination on the basis of gender.
