Texas law does not permit a partner to make a medical decision on behalf of an incapacitated same-sex partner in the absence of an advance directive. § 313.004.An adult may designate his or her same sex partner as a health care agent through an advance health care directive. To be valid the directive must be signed by the declarant in the presence of two witnesses. § 166.154.
