Ohio law does not permit partners to make medical decisions on behalf of incapacitated same-sex partners in the absence of a written directive. § 2133.08.An adult may designate his or her partner a health care agent through a durable power of attorney for health care. It shall be signed at the end of the instrument by the declarant state the date of its execution and acknowledged before a notary public. § 1337.12.
