Montana law does not allow for a partner to make decisions on behalf of his or her incapacitated partner. § 50-9-106.An adult may, through a written declaration, give his or her partner authority to make certain medical decisions in the event of incapacitation. A valid declaration requires the signature of the principal and two witnesses. § 50-9-103.
