Kansas Healthcare Laws

Kansas Marriage/Relationship Recognition Law

Kansas law and the state constitution both purport to ban recognition of marriages between same-sex couples. There are no other forms of relationship recognition for same-sex couples in state law or policies.

Kansas Sodomy Law

Kansas Surrogacy Law

It is unclear how Kansas law would treat a surrogacy agreement that includes lesbian, gay, bisexual or transgender (LGBT) individuals because there are no statutes regarding surrogacy. However, two attorney general opinions indicate that surrogate parenting agreements in general are unenforceable in the state.

Kentucky Custody and Visitation Law

Kentucky courts have used a parent’s sexual orientation to deny, restrict or modify custody and visitation. The Kentucky Supreme Court, however, has recognized parental rights for a non-biological co-parent in a same-sex relationship. There are no reported or published opinions dealing with transgender parents or same-sex co-parents.

Kentucky Donor Insemination Law

Kentucky law permits unmarried women to undergo donor insemination.
